Supreme Court Refuses to Stay Sonam Raghuvanshi’s Bail in Honeymoon Murder Case; Raises Questions Over High Court’s Reasoning

Apex Court Declines Immediate Intervention but Expresses Prima Facie Reservations; Meghalaya Government’s Challenge to Bail Remains Under Consideration

The Supreme Court on Friday declined to stay the bail granted to Sonam Raghuvanshi, the prime accused in the sensational Raja Raghuvanshi honeymoon murder case. However, the apex court indicated that it had prima facie reservations regarding the reasoning adopted by the Meghalaya High Court while upholding her release.

A Bench comprising Justices M.M. Sundresh and Sheel Nagu heard the Meghalaya government’s plea challenging the High Court’s order. Despite questioning aspects of the High Court’s approach, the Bench refused to suspend the bail immediately, noting that Sonam had already been released and was complying with the conditions imposed by the trial court.

The Meghalaya government, represented by Solicitor General Tushar Mehta, argued that the allegations against Sonam are extremely serious and that bail should not have been sustained merely because of procedural defects in the arrest documents. During the hearing, the prosecution also claimed that investigators possess evidence suggesting extensive planning behind the alleged murder.

The controversy stems from the Meghalaya High Court’s decision to uphold bail after finding procedural irregularities, including an error in the arrest memo and concerns regarding compliance with statutory safeguards during arrest. The Supreme Court observed that while such issues deserve judicial scrutiny, they may not necessarily determine the outcome of the criminal trial itself.

The case has remained one of India’s most closely watched criminal investigations since Raja Raghuvanshi and his wife Sonam, residents of Indore, travelled to Meghalaya for their honeymoon in May 2025. The couple disappeared during the trip, and Raja’s body was later recovered from a gorge near Sohra (Cherrapunji). The investigation subsequently led to Sonam’s arrest on allegations that she conspired to have her husband murdered with the help of hired assailants. She has denied the allegations, and the trial is yet to conclude.

Following the Supreme Court’s refusal to stay the bail, members of Raja Raghuvanshi’s family expressed disappointment and reiterated their demand for a thorough investigation, with some continuing to seek a Central Bureau of Investigation (CBI) probe into the case.

Legal experts note that the Supreme Court’s order does not amount to an endorsement of the High Court’s reasoning. Instead, it reflects the Court’s reluctance to send an accused back to custody after release without a fuller examination of the legal issues raised in the State’s challenge. The proceedings on the government’s plea are expected to continue, and the Court may examine the legality of the High Court’s judgment in greater detail during subsequent hearings.

The decision ensures that Sonam Raghuvanshi remains on bail for the present, while the criminal trial and the State’s challenge to the bail order continue before the courts. The final determination of her guilt or innocence will depend on the evidence presented during trial, and the allegations remain subject to judicial adjudication.
